Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Elite Athlete Support mobile application and related services (the "Service"), operated by Athlete Support Inc. ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who Can Use the Service

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent that you are 18 or older and that the information you provide is accurate and complete.

2. What Elite Athlete Support Is

The Service is a platform that lets athletes and teams create public profiles, share updates, build an audience of followers, and receive financial support from supporters. We provide the platform that connects athletes, teams, and supporters. We are not a party to any financial arrangement between a supporter and an athlete or team.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you believe your account has been compromised. You may not share your account, impersonate any person or organization, or misrepresent your affiliation with a person or organization.

4. Financial Support and Payments

Financial support on the Service — including one-time contributions and recurring subscriptions — is processed by our third-party payment provider, Stripe. By supporting an athlete or team, or by receiving support, you also agree to Stripe's applicable terms. We do not store your full payment card details.

• Contributions to athletes and teams are voluntary. All support — one-time contributions and each recurring payment — is final and non-refundable, except as required by law. You can cancel a recurring subscription at any time to stop future payments.
• Athletes and teams that receive support are responsible for their own tax obligations relating to funds they receive.
• Athletes and teams can receive payouts in the United States, Canada, the United Kingdom, Switzerland and countries in the European Economic Area. Your payout country is the country on your profile when you set up payments, and it can't be changed once your payout account is active.
• Support is charged in US dollars. If you receive payouts outside the United States, Stripe converts them to your local currency. Currency conversion may reduce the amount you receive, and exchange rates are set by Stripe at the time of payout.
• If you receive payouts outside the United States, you are responsible for any taxes, reporting and legal requirements in your country, in addition to any US requirements that apply to you.
• We are not responsible for how an athlete or team uses funds they receive through the Service.

5. Content You Post

You retain ownership of the content you post — including profile information, photos, updates, and newsletters ("Your Content"). By posting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it for the purpose of operating and promoting the Service.

You are solely responsible for Your Content and represent that you have the rights necessary to post it and that it does not violate these Terms or any law.

6. Acceptable Use

You agree not to:

• Post content that is unlawful, harassing, hateful, defamatory, sexually explicit, or that exploits or endangers minors;
• Impersonate any person or organization or misrepresent your identity or affiliation;
• Use the Service to defraud, deceive, or solicit money under false pretenses;
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its systems;
• Use the Service in violation of any applicable law or regulation.

7. Supporter Recognition

When you support an athlete or team, your supporter name is shown on their profile by default. You can choose "Support anonymously" when you give, or hide your name anytime in Supporter Settings. Supporters may choose to display an optional logo and link as recognition on the profiles and newsletters of athletes and teams they support. You are responsible for ensuring you have the right to use any logo or brand you upload.

8. Content Moderation and Termination

We may remove content or suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users or to the Service. You may stop using the Service and delete your account at any time.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, secure, or error-free, and we do not endorse or guarantee any athlete, team, supporter, or the accuracy of any content posted on the Service.

10. Limitation of Liability

To the fullest extent permitted by law, Athlete Support Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, data, or goodwill, arising out of or relating to your use of the Service.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where a mandatory consumer-protection law of your place of residence applies.
